Amini Swiss Prime Estate AG takes the protection of your personal data seriously. In this privacy policy, we explain which data we process, for what purpose and what rights you have.

This policy applies to our website amini-spe.ch and to our presence on social media platforms.

2. Applicable law

We process personal data in accordance with the revised Swiss Federal Act on Data Protection (FADP) and the associated Data Protection Ordinance (DPO), both in force since 1 September 2023. Where the European General Data Protection Regulation (GDPR) applies to processing, we also comply with its requirements.

3. Principles of processing

We process personal data lawfully, in good faith, proportionately and transparently, and only for the purpose stated when the data was collected (Art. 6 FADP). We do not collect more data than we need for the relevant purpose.

Processing is based on one of the following grounds:

• your consent (Art. 6 para. 6 and Art. 31 para. 1 FADP; Art. 6 para. 1 lit. a GDPR),
• the performance of a contract with you or the implementation of pre-contractual measures (Art. 31 para. 2 lit. a FADP; Art. 6 para. 1 lit. b GDPR),
• a legal obligation, such as retention obligations under commercial and tax law (Art. 31 para. 1 FADP; Art. 6 para. 1 lit. c GDPR),
• our overriding legitimate interest, in particular in the secure and stable operation of the website (Art. 31 FADP; Art. 6 para. 1 lit. f GDPR).

4. Which data we process

4.1 Server log files

When you access the website, your browser transmits technically necessary data, which is logged by our hosting provider: IP address, date and time of the request, page accessed, HTTP status code, volume of data transferred, referring website, and browser and operating system information.

This processing is necessary for the operation, stability and security of the website and is based on our overriding legitimate interest. This data is not combined with other data sources.

4.2 Cookies and consent

We use technically necessary cookies required for the operation of the website. This includes a cookie that stores your selection in the consent banner, so that we do not ask you again on every visit.

Cookies for analytical purposes are set only after you have given your express consent in the banner. You may withdraw your consent at any time with effect for the future by changing your selection in the banner or deleting the cookies in your browser.

The fonts used on this website are delivered from our own server. When you visit the website, no connection is therefore established to an external font provider.

4.3 Contact form

When you contact us via the contact form, we process your title, first and last name, email address, telephone number, whether you are a business or private client, your company where applicable, and your message. We also store the time of submission, browser identifier and a shortened checksum of your IP address to detect misuse and automated submissions. The checksum is generated using a secret key known only to us; the IP address itself is not stored and cannot be reconstructed from the checksum.

If you send your enquiry from the page of a specific property, we assign it to that property and also forward it to the relevant contact person.

We use this information solely to process your enquiry and for related correspondence.

4.4 Search profile

If you create a personal search profile, we process the search criteria and contact details you provide in order to inform you about suitable properties. You may request the deletion of your search profile at any time.

4.5 Newsletter

For the newsletter, we process your email address and first and last name. Registration is voluntary and based on your consent. After submitting the form, you will receive an email with a confirmation link; your address will only be added to the mailing list once you click this link (double opt-in). We use Mailchimp to send the newsletter and manage the mailing list; see section 5.2. You may unsubscribe from the newsletter at any time, for example using the unsubscribe link at the end of each newsletter email; we will then remove your data from the mailing list.

4.6 Online valuation tool

On the “Property valuation” page, we integrate a valuation tool provided by RealAdvisor SA. The information you enter in this tool is processed directly by RealAdvisor. The provider's privacy policy applies: realadvisor.ch/de/privacy.

5. Service providers and processors

We use carefully selected service providers that process personal data on our behalf and in accordance with our instructions (Art. 9 FADP, Art. 28 GDPR). They are contractually obliged to maintain confidentiality and implement appropriate technical and organisational measures.

5.1 Google Analytics

We use Google Analytics 4 to understand how our website is used and to improve it on an ongoing basis. Google Analytics uses cookies and collects information such as pages visited, time spent on the site, approximate region of origin, device type and browser. Google Analytics 4 does not store IP addresses; the address is used only to determine an approximate location and is then discarded. Any further analysis carried out by Google depends on the settings of our Google account.

Google Analytics is loaded only after you have consented to the Statistics category in the consent banner. Without your consent, no Google script is loaded and no analytics cookie is set. If you withdraw your consent, data collection will cease.

The legal basis is your consent (Art. 31 para. 1 FADP; Art. 6 para. 1 lit. a GDPR). You can also disable data collection using the Google browser add-on.

5.2 Mailchimp

We use Mailchimp, a service of Intuit Inc., 2700 Coast Avenue, Mountain View, CA 94043, USA, to send our newsletter. Your email address, first and last name, and the time of your registration and confirmation are stored on Mailchimp servers and processed there on our behalf.

Mailchimp records whether a newsletter email has been delivered and opened, and whether links contained in it have been clicked. This information helps us tailor the newsletter to the interests of our readers. The legal basis is your consent (Art. 31 para. 1 FADP; Art. 6 para. 1 lit. a GDPR). You may withdraw this consent at any time with effect for the future by unsubscribing from the newsletter.

Processing takes place in the United States. The disclosure is based on standard contractual clauses approved by the European Commission. Details of how Intuit handles personal data can be found in its privacy policy.

6. Disclosure abroad

Amini Swiss Prime Estate AG is based in Switzerland. In operating the website, personal data may be disclosed to service providers abroad, in particular in the European Union, Norway and the USA.

Data is disclosed only where the relevant country provides an adequate level of data protection (Art. 16 para. 1 FADP in conjunction with Annex 1 DPO) or where adequate protection is otherwise ensured, in particular through standard contractual clauses recognised by the FDPIC or certification of the recipient under the Swiss-U.S. Data Privacy Framework (Art. 16 para. 2 FADP).

7. Retention period

We process personal data for as long as necessary for the relevant purpose. The data is then deleted or anonymised. Where statutory retention obligations apply, for example under the Swiss Code of Obligations or tax law, we retain the relevant documents until these periods have expired.

8. Your rights

As a data subject (Art. 5 lit. b FADP), you have the following rights:

• information on whether and which personal data we process about you (Art. 25 FADP),
• correction of inaccurate personal data (Art. 32 para. 1 FADP),
• deletion or destruction of your personal data and objection to processing (Art. 32 para. 2 FADP),
• the release or transfer of your data in a commonly used electronic format, provided processing is based on your consent or a contract and is carried out automatically (Art. 28 FADP),
• Withdrawal of consent previously given, effective for the future; the lawfulness of processing carried out up to that point remains unaffected.

Where the GDPR applies, the rights to restriction of processing, data portability and objection under Articles 15 to 21 GDPR also apply.

To exercise your rights, simply send a message to contact@amini-spe.ch. For security reasons, we may request proof of identity.

You also have the right to contact the Federal Data Protection and Information Commissioner (FDPIC) or, where the GDPR applies, to lodge a complaint with a competent supervisory authority.

9. Social media presence

We maintain profiles on social media platforms to provide information about our activities and to stay in touch with you. We have no influence over the processing of data by platform operators, which they carry out under their own responsibility.

When you visit one of these profiles, the operators generally store cookies in your browser and analyse your usage behaviour for market research and advertising purposes. Information on options for objecting and rights of access can be found in the respective provider's Privacy Policy.

10. External links and images

Our website links to external websites in certain places. We have no influence over their content or data processing; you access them at your own responsibility.

For some of the images used, we rely on image material from external providers, made available to us under a licence for use.

11. Data security

We take appropriate technical and organisational measures to protect your personal data against unauthorised access, loss and misuse (Art. 8 FADP, Art. 1 et seq. DPO). This website is encrypted throughout using HTTPS. We continuously adapt our security measures to technological developments.

12. Amendments

We may amend this Privacy Policy at any time, for example if our services, the service providers we use or legal requirements change. The version published on this page at any given time shall apply.
